Restoration of Visitor Status in Canada


If you have stayed in Canada beyond your authorized period as a visitor, you may still be eligible to restore your visitor status—provided you act promptly and meet certain eligibility conditions. A restoration request allows you to regain legal status without leaving Canada.

Who Can Apply for Restoration ?


You may apply to restore your visitor status if:
● Your visitor status expired within the past 90 days.
● You did not work or study without authorization.
● You have continued to meet the conditions of your original stay.
● You have not violated other immigration laws or conditions.
Note: Restoration is only available inside Canada and cannot be applied for at a port of entry.

When to Apply ?


You must apply within 90 days of losing your status. Restoration applications submitted after this period will be refused, and you will be required to leave Canada.

Required Documents for Restoration


When applying, you must include:

● Completed [IMM 5708] Application to Change Conditions or Extend Stay

● A written explanation for the overstay and why restoration is being requested

● Proof of financial support

● A copy of your passport (all pages with stamps/visas)

● Any documents showing ties to your home country

● Processing fee payment ($100 for visitor record + $200 for restoration)

Application Process


1. Complete Forms: Fill out the IMM 5708 application form online through the IRCC portal.

2. Prepare Documents: Ensure documents are in English or French and include scanned/electronic versions.

3. Pay Fees: Restoration fee + visitor record fee.

4. Submit Online: Upload documents and submit via IRCC’s secure portal. 5. Wait for Decision: IRCC will notify you via your account. Processing times vary by case.

Maintained Status (Previously Implied Status)


If you applied before your original status expired, you can stay in Canada under maintained status until a decision is made. However, if your application was submitted after the expiry date, you must not work or study while awaiting a decision.

Important Considerations


● Restoration is not guaranteed; approval is at the discretion of IRCC.

● If your application is refused, you must leave Canada immediately.

● Overstaying can affect future immigration applications.
